Art. 43 Loi sur la gestion des eaux (LGEaux)
1 Sont compétents pour octroyer des concessions
a) le Gouvernement pour les concessions de force hydraulique supérieures à 50 kilowatt théorique;
b) le Département pour les autres concessions de force hydraulique et pour les concessions d'approvisionnement en eau potable;
c) l'Office de l'environnement pour les autres concessions.
2 Les compétences de la Confédération en vertu de la législation fédérale sur l'utilisation des forces hydrauliques sont réservées.
3 L'Office de l'environnement est compétent pour délivrer les autorisations lorsque la présente loi n'en dispose pas autrement.
