Art. 28 KESV · Verzicht auf Kostenerhebung

1. Besondere Umstände, die den teilweisen oder ganzen Verzicht auf die Erhebung von Verfahrenskosten rechtfertigen, können insbesondere vorliegen bei

a) Absehen von der Anordnung einer Massnahme;

b) Kindesschutzmassnahmen, sofern das steuerrechtliche Reinvermögen der Eltern unter dem Freibetrag von 50 000 Franken beziehungsweise für Alleinstehende unter dem Freibetrag von 30 000 Franken liegt;

c) Personen, die nachweislich auf die Unterstützung der öffentlichen Sozialhilfe angewiesen sind;

d) Erwachsenenschutzmassnahmen, sofern durch die Erhebung von Verfahrenskosten die in den Ausführungsbestimmungen zum Unterstützungsgesetz enthaltenen Vermögensfreigrenzen unterschritten würden.

2. Die Vermögensverhältnisse sind von der betroffenen Person, den Eltern, dem sorgeberechtigten oder dem unterhaltspflichtigen Elternteil gegenüber der Kindes- und Erwachsenenschutzbehörde offen zu legen.
