Parental Liability for Child Protection Investigation Costs Upheld
This provision was applied to rule that the procedure costs are generally split equally between the parents.
ZK1 2013 129 · gr (Art. 27 Abs. 2 KESV)
Child Contact Supervision and Cost Allocation Following Findings of Domestic Violence
This provision was cited by the KESB in its reasoning for the initial cost allocation, but not explicitly in the final orders of the Cantonal Court; however, the final orders concerning costs (Order 2) implicitly rely on the cost rules applied/reviewed, which stem from this context. Since the final orders only cite procedural rules for appeal costs (ZPO) and procedural rules for the appeal itself, and no substantive provision was used in Order 1, I must check if any provision was used in Order 2 of the final decision. Order 2 of the final decision cites provisions for calculating appeal costs (Art. 10 and 2/3, 1/3 split), not Art. 27 Abs. 2 KESV directly. Therefore, Art. 27 Abs. 2 KESV is excluded as it is only mentioned in the reasoning leading up to the final orders regarding costs.

Father's Liability for Child Welfare Guardianship Costs Despite Financial Hardship
Cited in the reasoning as the provision allowing for different cost apportionment in special circumstances, which was part of the legal basis for the KESB's initial order.
