Art. 58 EGzZGB · 3. Verfahrensleitung und Instruktion a) Allgemein
1. Die Leiterin beziehungsweise der Leiter der Kindes- und Erwachsenenschutzbehörde oder ein von ihr oder ihm bezeichnetes Behördenmitglied leitet und instruiert das Verfahren.
2. In die Zuständigkeit der Verfahrensleitung fallen insbesondere
a) Anordnung von vorsorglichen Massnahmen bei besonderer Dringlichkeit (Art. 445 Abs. 2);
b) Anordnung einer Vertretung für das Kindes- oder Erwachsenenschutzverfahren (Art. 314abis und Art. 449a);
c) Gewährung der unentgeltlichen Rechtspflege;
d) * Erlass von Abschreibungs- und Nichteintretensverfügungen;
e) * Anordnung oder Entzug der aufschiebenden Wirkung im Rechtsmittelverfahren (Art. 450c und Art. 450e);
f) * Erlass von Vollstreckungsverfügungen (Art. 450g).
