Art. 171 LATeC · Exécution par substitution

1. Si, dans un délai convenable fixé par respectivement la Direction, le préfet ou la commune, le ou la propriétaire n'obtempère pas à l'ordre reçu, en application des articles 164 al. 1, 167 et 170, l'autorité compétente fait exécuter les travaux aux frais du ou de la propriétaire.

2. S'il y a péril en la demeure ou s'il apparaît d'emblée que le ou la propriétaire ne veut pas ou ne peut pas exécuter son obligation dans un délai raisonnable, l'exécution par substitution peut avoir lieu sans sommation préalable.

3. Le montant des frais selon le décompte final peut faire l'objet d'un recours limité à l'arbitraire.

4. Les frais d'exécution par substitution sont garantis par une hypothèque légale (art. 73 LACC).
