Art. 134a CPJA · Procédures en matière de personnel

1. La procédure de recours hiérarchique est gratuite lorsqu'elle porte sur les rapports de travail du personnel de l'Etat et de ses établissements.

2. La procédure de recours devant le Tribunal cantonal est gratuite dans la mesure prévue en matière de prud'hommes ainsi que dans les cas soumis à la législation sur l'égalité entre femmes et hommes. Cette règle vaut également pour les recours devant le préfet et devant le Tribunal cantonal qui portent sur les rapports de travail du personnel soumis à la loi sur les communes.

3. Dans tous les cas, des frais peuvent être mis à la charge de la partie qui les a occasionnés par sa faute ou en cas de procédure téméraire, abusive ou introduite à la légère.
