Art. 10 VStG
Steuerpflichtig ist der Schuldner der steuerbaren Leistung.
Bei kollektiven Kapitalanlagen gemäss KAG sind die Fondsleitung, die Investmentgesellschaft mit variablem Kapital, die Investmentgesellschaft mit festem Kapital und die Kommanditgesellschaft steuerpflichtig. Haben eine Mehrheit der unbeschränkt haftenden Gesellschafter einer Kommanditgesellschaft für kollektive Kapitalanlagen ihren Wohnsitz im Ausland oder handelt es sich bei den unbeschränkt haftenden Gesellschaftern um juristische Personen, an denen eine Mehrheit von Personen mit Wohnsitz oder Sitz im Ausland beteiligt sind, haftet die Depotbank der Kommanditgesellschaft solidarisch für die Steuer auf den ausbezahlten Erträgen.
