Art. 98 ZPO · Kostenvorschuss
Das Gericht und die Schlichtungsbehörde können von der klagenden Partei einen Vorschuss von höchstens der Hälfte der mutmasslichen Gerichtskosten verlangen.
Sie können einen Vorschuss bis zur Höhe der gesamten mutmasslichen Gerichtskosten verlangen in: a. Verfahren nach Artikel 6 Absatz 4 Buchstabe c und nach Artikel 8; b. Schlichtungsverfahren; c. summarischen Verfahren mit Ausnahme der vorsorglichen Massnahmen nach Artikel 248 Buchstabe d und der familienrechtlichen Streitigkeiten nach den Artikeln 271, 276, 302 und 305; d. Rechtsmittelverfahren.
