Art. 8 ZPO · Direkte Klage beim oberen Gericht
In vermögensrechtlichen Streitigkeiten kann die klagende Partei mit Zustimmung der beklagten Partei direkt an das obere Gericht gelangen, sofern der Streitwert mindestens 100 000 Franken beträgt.
Dieses Gericht entscheidet als einzige kantonale Instanz. Es ist auch für die Anordnung vorsorglicher Massnahmen vor Eintritt der Rechtshängigkeit zuständig.
