Art. 29 ZPO · Grundstücke

Für die folgenden Klagen ist das Gericht am Ort, an dem das Grundstück im Grundbuch aufgenommen ist oder aufzunehmen wäre, zuständig: a. dingliche Klagen; b. Klagen gegen die Gemeinschaft der Stockwerkeigentümerinnen und Stockwerkeigentümer; c. Klagen auf Errichtung gesetzlicher Pfandrechte.

Andere Klagen, die sich auf Rechte an Grundstücken beziehen, können auch beim Gericht am Wohnsitz oder Sitz der beklagten Partei erhoben werden.

Bezieht sich eine Klage auf mehrere Grundstücke oder ist das Grundstück in mehreren Kreisen in das Grundbuch aufgenommen worden, so ist das Gericht an dem Ort zuständig, an dem das flächenmässig grösste Grundstück oder der flächenmässig grösste Teil des Grundstücks liegt.

Für Angelegenheiten der freiwilligen Gerichtsbarkeit, die sich auf Rechte an Grundstücken beziehen, ist das Gericht an dem Ort zwingend zuständig, an dem das Grundstück im Grundbuch aufgenommen ist oder aufzunehmen wäre.
