Art. 718b OR
Wird die Gesellschaft beim Abschluss eines Vertrages durch diejenige Person vertreten, mit der sie den Vertrag abschliesst, so muss der Vertrag schriftlich abgefasst werden. Dieses Erfordernis gilt nicht für Verträge des laufenden Geschäfts, bei denen die Leistung der Gesellschaft den Wert von 1000 Franken nicht übersteigt.
