Art. 760 ZGB
Der Eigentümer ist befugt, von dem Nutzniesser Sicherheit zu verlangen, sobald er eine Gefährdung seiner Rechte nachweist.
Ohne diesen Nachweis und schon vor der Übergabe der Sache kann er Sicherheit verlangen, wenn verbrauchbare Sachen oder Wertpapiere den Gegenstand der Nutzniessung bilden.
Für die Sicherstellung bei Wertpapieren genügt deren Hinterlegung.
