Art. 602 ZGB
Beerben mehrere Erben den Erblasser, so besteht unter ihnen, bis die Erbschaft geteilt wird, infolge des Erbganges eine Gemeinschaft aller Rechte und Pflichten der Erbschaft.
Sie werden Gesamteigentümer der Erbschaftsgegenstände und verfügen unter Vorbehalt der vertraglichen oder gesetzlichen Vertretungs- und Verwaltungsbefugnisse über die Rechte der Erbschaft gemeinsam.
Auf Begehren eines Miterben kann die zuständige Behörde für die Erbengemeinschaft bis zur Teilung eine Vertretung bestellen.
