Art. 46 ZGB

Wer durch die im Zivilstandswesen tätigen Personen in Ausübung ihrer amtlichen Tätigkeit widerrechtlich verletzt wird, hat Anspruch auf Schadenersatz und, wo die Schwere der Verletzung es rechtfertigt, auf Genugtuung.

Haftbar ist der Kanton; er kann auf die Personen, welche die Verletzung absichtlich oder grobfahrlässig verursacht haben, Rückgriff nehmen.

Auf Personen, die vom Bund angestellt sind, findet das Verantwortlichkeitsgesetz vom 14. März 1958 Anwendung.
