Art. 458 ZGB
Hinterlässt der Erblasser keine Nachkommen, so gelangt die Erbschaft an den Stamm der Eltern.
Vater und Mutter erben nach Hälften.
An die Stelle von Vater oder Mutter, die vorverstorben sind, treten ihre Nachkommen, und zwar in allen Graden nach Stämmen.
Fehlt es an Nachkommen auf einer Seite, so fällt die ganze Erbschaft an die Erben der andern Seite.
