Art. 52 Gesetz über die öffentliche Sozialhilfe (Sozialhilfegesetz, SHG) · Rechtsschutz

1. Gegen Verfügungen der Sozialdienste und von öffentlichen und privaten Trägerinnen und Trägern im Zuständigkeitsbereich der Gemeinden kann bei der Regierungsstatthalterin oder beim Regierungsstatthalter Beschwerde erhoben werden. Gegen Verfügungen von öffentlichen oder privaten Trägerinnen und Trägern im Zuständigkeitsbereich der Gesundheits-, Sozial- und Integrationsdirektion kann Beschwerde an diese erhoben werden.

2. Anstelle der Regierungsstatthalterin oder des Regierungsstatthalters entscheidet die Oberwaisenkammer über Beschwerden gegen Verfügungen der Sozialhilfebehörden der Burgergemeinde Bern sowie ihrer Zünfte und Gesellschaften. Der Regierungsrat regelt die Organisation der Oberwaisenkammer durch Verordnung.

3. Beschwerdeentscheide unterliegen der Beschwerde an das Verwaltungsgericht.

4. Zur Prozessvertretung vor den Beschwerdeinstanzen sind Personen und Organisationen nach freier Wahl der beschwerdeführenden Person zugelassen.
