Art. 52 Dekret über das Baubewilligungsverfahren (Baubewilligungsdekret, BewD) · Kostenpflicht im Baubewilligungsverfahren

1. Die Gesuchstellenden tragen die amtlichen Kosten des Baubewilligungsverfahrens. Parteikosten werden keine gesprochen.

2. Bei der Bestimmung der Verfahrenskosten ist der Bedeutung der Bausache angemessen Rechnung zu tragen; insbesondere kann bei kleinen Bauvorhaben oder bei verhältnismässig hohen Expertisenkosten von einer vollen Kostenüberwälzung an die Gesuchstellenden abgesehen werden.

3. Den Einsprechenden können die amtlichen Kosten auferlegt werden, die sie durch eine offensichtlich unbegründete Einsprache verursacht haben.
