Art. 43 Dekret über das Baubewilligungsverfahren (Baubewilligungsdekret, BewD) · Projektänderungen während des Verfahrens und während der Bauausführung

1. Eine Projektänderung im Sinne dieser Bestimmung liegt vor, wenn das Bauvorhaben in seinen Grundzügen gleich bleibt.

2. Die Baubewilligungsbehörde kann nach Anhörung der Beteiligten und der von der Projektänderung berührten Dritten das Verfahren ohne erneute Veröffentlichung fortsetzen bzw. die Änderung des bewilligten Projekts ohne neues Baugesuchsverfahren gestatten, wenn öffentliche oder wesentliche nachbarliche Interessen nicht zusätzlich betroffen sind.

3. Erfolgt die Projektänderung im Baubeschwerdeverfahren, sind die Gemeinde, die Gegenpartei und die von der Projektänderung berührten Dritten anzuhören. Die Beschwerdeinstanz kann die Sache zur Weiterbehandlung an die Vorinstanz zurückweisen.

4. Im Beschwerdeverfahren vor Verwaltungsgericht sind Projektänderungen ausgeschlossen. Vorbehalten bleibt die Befugnis des Verwaltungsgerichts, die Sache zwecks Prüfung einer Projektänderung an die Vorinstanz zurückzuweisen oder das Beschwerdeverfahren durch Vergleich zu erledigen.

5. Erfolgt die Projektänderung erst während der Bauausführung, richtet sich die Zuständigkeit allein nach der Änderung. Es ist das im Zeitpunkt der Einreichung der Projektänderung geltende Recht anzuwenden.
