Art. 43 Baugesetz (BauG) · Widerruf der Baubewilligung
1. Eine im Widerspruch zu öffentlich-rechtlichen Vorschriften erteilte oder bei ihrer Ausübung mit der öffentlichen Ordnung nicht mehr vereinbare Baubewilligung kann von der Baubewilligungsbehörde - gegebenenfalls von der nach Artikel 48 zuständigen Behörde - widerrufen werden.
2. Sind aufgrund der Baubewilligung bereits erhebliche Arbeiten ausgeführt, so ist der Widerruf nur zulässig,
a. wenn überwiegende Interessen ihn gebieten; der Bauherr ist nach den Bestimmungen über die materielle Enteignung (Art. 130) zu entschädigen, wenn dafür die Voraussetzungen erfüllt sind;
b. wenn der Gesuchsteller die Bewilligung durch Irreführung erwirkt hat.
3. Die Widerrufsverfügung ist sofort vollstreckbar. Sie kann wie ein Bauentscheid angefochten werden.
