Art. 38 Baugesetz (BauG) · 3 Prüfung; Gegenstände
1. Nach der formellen Prüfung leitet die Gemeindeverwaltung die Bau- und Ausnahmegesuche sofort an die Baubewilligungsbehörde weiter und weist auf offenkundige materielle Mängel hin.
2. Im Bauentscheid wird geurteilt über das Baugesuch und die zugehörigen Ausnahmegesuche sowie die Kostenpflicht. Der Bauentscheid setzt sich mit den unerledigten Einsprachen auseinander.
3. Mit der Baubewilligung können Bedingungen und Auflagen verbunden werden; Artikel 29 Absätze 2 bis 4 sind sinngemäss anwendbar.
4. Im Dispositiv des Bauentscheides ist anzugeben,
a) welche weiteren Bewilligungen der Bauherr im Fall von Artikel 2a Absatz 2 Buchstabe b noch beizubringen hat,
b) welche Gesuchsgegenstände im Fall der Teilbaubewilligung (Art. 32c) noch beurteilt werden müssen.
