Art. 47 Notariatsgesetz (NG) · Disziplinarmassnahmen und Gewinneinzug

1. Disziplinarmassnahmen sind

a) Verweis,

b) Busse bis zu 20 000 Franken,

c) Suspendierung des Eintrags im Notariatsregister für die Dauer von einem Monat bis zu zwei Jahren,

d) Löschung des Eintrags im Notariatsregister.

2. Disziplinarmassnahmen können miteinander verbunden werden.

2a. Nebst einer Disziplinarmassnahme kann der Einzug eines unrechtmässig realisierten Gewinns verfügt werden.

3. Nach Löschung oder Suspendierung des Eintrags einer Person im Notariatsregister darf diese keine Handlungen vornehmen, welche in die hauptberufliche Zuständigkeit der Notarinnen und Notare fallen.

4. Der Antrag auf Löschung des Eintrags im Notariatsregister oder der Verzicht auf das Notariatspatent schliesst die Suspendierung des Eintrags als Disziplinarmassnahme nicht aus.

5. Nach der disziplinarischen Löschung des Eintrags im Notariatsregister ist eine Wiedereintragung vor Ablauf einer Frist von drei Jahren ausgeschlossen.
