Art. 38 Notariatsgesetz (NG) · Aufsichtsbehörde

1. Die Direktion für Inneres und Justiz ist Aufsichtsbehörde über das Notariat. Sie erteilt das Notariatspatent, überwacht die Einhaltung der für die Berufsausübung geltenden Vorschriften und führt das Notariatsregister.

2. Sie führt die Untersuchung und entscheidet

a) über den Entzug und die Wiedererteilung des Notariatspatents,

b) über die Löschung und die Suspendierung des Eintrags sowie die Wiedereintragung im Notariatsregister,

c) in Disziplinarfällen,

d) über Gesuche betreffend die amtliche Festsetzung von Gebühren und Auslagen.

3. Sie kann zur Beseitigung drohender oder festgestellter gesetzwidriger Zustände sowie zum Schutz erheblicher öffentlicher oder privater Interessen Weisungen erteilen und vorsorgliche Massnahmen anordnen.

4. Sie ist zuständig für die Revision der Notariatsbüros. Sie kann geeignete Personen oder Organisationen mit der Durchführung beauftragen.
