Art. 35 Kantonales Anwaltsgesetz (KAG) · Verfahrenskosten
1. Die Verfahrenskosten werden der Anwältin oder dem Anwalt auferlegt, soweit eine Verletzung der Berufsregeln festgestellt wird.
2. Wird von der Eröffnung eines Disziplinarverfahrens abgesehen oder wird das Verfahren aufgehoben, trägt in der Regel der Kanton die Verfahrenskosten. Sie können jedoch auch ganz oder teilweise auferlegt werden
a) der Anwältin oder dem Anwalt, sofern sie oder er das Verfahren mutwillig oder grobfahrlässig veranlasst oder dessen Durchführung in rechtlich vorwerfbarer Weise erschwert hat,
b) der anzeigenden Person, sofern sie mutwillig oder grobfahrlässig gehandelt hat.
