Art. 32 Kantonales Anwaltsgesetz (KAG) · Anzeige, Meldung und Einleitung von Amtes wegen
Vorfälle, die ein Einschreiten gegen eine Anwältin oder einen Anwalt als erforderlich erscheinen lassen, können der Anwaltsaufsichtsbehörde angezeigt werden.
Wer anzeigt, hat im Disziplinarverfahren keine Parteistellung, kann aber verlangen, dass ihm Auskunft über die Art der Erledigung der Anzeige erteilt wird.
Die Pflicht der Gerichte, Verwaltungs- und Strafverfolgungsbehörden, der Anwaltsaufsichtsbehörde Vorfälle zu melden, welche die anwaltlichen Berufspflichten verletzen könnten, richtet sich nach Artikel 15 BGFA.
Die Anwaltsaufsichtsbehörde kann das Verfahren auch von Amtes wegen einleiten.
