Art. 28 Verfassung des Kantons Bern (KV) · Schranken der Grundrechte, Kerngehalt

1. Jede Einschränkung eines Grundrechts bedarf einer Grundlage im Gesetz. Inhalt, Zweck und Umfang sind hinreichend zu bestimmen. Vorbehalten bleiben Fälle ernster, unmittelbarer und offensichtlicher Gefahr, insbesondere wenn Leben und Gesundheit von Menschen, die Ausübung demokratischer Rechte oder nicht wiedergutzumachende Schäden an der Umwelt in Frage stehen.

2. Die Grundrechte können nur eingeschränkt werden, wenn der Schutz eines überwiegenden öffentlichen Interesses oder eines entgegenstehenden Grundrechts eines Privaten es rechtfertigt.

3. Die Einschränkungen müssen verhältnismässig sein.

4. Der Kern der Grundrechte ist unantastbar. Zum Kerngehalt gehören insbesondere Gewährleistungen, welche diese Verfassung als unantastbar bezeichnet oder bei denen sie Einschränkungen in keinem Fall zulässt.
