§ 1. Als Untergrenze jener Menge, die, bezogen auf die Reinsubstanz des Wirkstoffes geeignet ist, in großem Ausmaß eine Gefahr für das Leben oder die Gesundheit von Menschen herbeizuführen (Grenzmenge), wird für die einzelnen Suchtgifte, unter Bedachtnahme auch auf deren Eignung, Gewöhnung hervorzurufen, sowie auf das Gewöhnungsverhalten von Suchtkranken, die im Anhang dieser Verordnung jeweils angeführte Menge festgesetzt.

§ 2. Sofern hinsichtlich der im Anhang angeführten Suchtgifte das Bestehen von Salzen möglich ist, beziehen sich die Grenzmengen auf die Base des jeweiligen Suchtgiftes.

§ 3. (1) Diese Verordnung tritt mit 1. Jänner 1998 in Kraft.

(2) Der Anhang in der Fassung der Verordnung BGBl. II Nr. 371/2014 tritt mit 1. Jänner 2015 in Kraft.

(3) Der Anhang in der Fassung der Verordnung BGBl. II Nr. 211/2019 tritt mit Ablauf des Tages der Kundmachung in Kraft.

(4) Der Anhang in der Fassung der Verordnung BGBl. II Nr. 6/2024 tritt mit Ablauf des Tages der Kundmachung in Kraft.

(5) Der Anhang in der Fassung der Verordnung BGBl. II Nr. 233/2024 tritt mit Ablauf des Tages der Kundmachung in Kraft.
