The court annulled the second-instance judgment convicting the defendant for fraudulent bankruptcy without remanding the case. The prosecution argued that accounting irregularities proved specific intent, but the court noted the omission regarding conditional sentence suspension. The conviction was overturned because the crime had extinguished by prescription on July 14, 2022, rendering the penalty non-punishable.

Sentenza 208/2017
Italian Constitutional Court dismisses challenge to asset forfeiture procedure rules regarding mentally incapacitated defendants. The court rules that the specific procedural code applies even when the defendant cannot participate personally. The court holds that the right of defense is adequately protected by a legal guardian, making the proposed constitutional complaint unfounded. The decision clarifies that the nature of the actio in rem allows the state to proceed without the incapacitated person's direct presence. The court distinguishes between the fundamental structure of the proceeding and the specific evidentiary burdens, noting only the former is at issue here. This precedent ensures asset forfeiture cases can continue against incapacitated individuals represented by guardians. The ruling upholds the compatibility of the current code with constitutional rights in such scenarios.

la seguente SENTENZA sul ricorso proposto da: TOMASSETTI EMILIANO nato a FIRENZE il 17/04/1981 avverso la sentenza del 22/02/2022 della CORTE APPELLO di FIRENZEdato avviso alle parti; udita la relazione svolta dal Consigliere VINCENZO SGUBBI;

RITENUTO IN FATTO

E

CONSIDERATO IN DIRITTO
