The Federal Administrative Court (BVerwG) granted leave to appeal for revision, ruling that the lower court’s judgment deviated from established Senate jurisprudence and that the appeal is admissible under § 67 LDG NRW and § 132 Abs. 2 Nr. 2 VwGO. The dispute concerned a disciplinary sanction against a civil servant accused of embezzling funds, with the appellant challenging the lower court’s failure to properly assess mitigating circumstances during the penalty determination. The decisive legal basis was the requirement under § 13 Abs. 2 Satz 1 bis 3 LDG NRW that disciplinary assessments must not be limited to denying "classic" mitigating factors; the Court held that the lower court erred by ignoring the mitigating effect of the defendant returning the funds, even though the act was not voluntary, thereby requiring the higher court to re-evaluate the sanction in light of this deviation from prior case law.

Revisionszulassung wegen Abweichung; Milderungsgründe

[GRUENDE]
