Revision admissibility for Natura 2000 compatibility assessment where noise exceeds TA Lärm irrelevance threshold
Sintesi Legislator
Generato dall'IAThe Federal Administrative Court (BVerwG) ordered the admission of the plaintiff's revision appeal, vacating the Higher Administrative Court for North Rhine-Westphalia's decision of 29 November 2022 that had denied such admission, thereby allowing the case to proceed to the federal level with a provisional subject matter value of €60,000. The dispute concerns a challenge to the absence of an appropriateness assessment for a planned project, specifically whether such an assessment is legally required when noise-induced impacts on a Natura 2000 site fall below an irrelevance threshold. The decisive legal basis identified for clarification is § 34(1) of the Federal Nature Conservation Act (BNatSchG) in conjunction with the noise relevance threshold defined in Nr. 3.2.1 Abs. 2 of the Technical Instruction on Noise Abatement (TA Lärm) from 1998.
