The Federal Administrative Court (BVerwG) granted the plaintiff legal aid without installments and assigned counsel, overturned the Bavarian Administrative Court of Appeal's decision denying permission to appeal, and admitted the revision to the higher court, leaving the cost determination to the main proceedings and setting the temporary matter in dispute value at €8,712.48. The dispute concerned the denial of admission to the legal preparatory service (juristischer Vorbereitungsdienst) based on suitability requirements, with the plaintiff challenging the lower courts' refusal to permit a further appeal. The decisive legal basis for the revision's admission was the fundamental significance of the case under § 132 Abs. 2 Nr. 1 VwGO, specifically the unresolved question of whether suitability standards that would not justify denying admission to the bar profession can validly support a refusal to enter the legal preparatory service, while the grant of legal aid relied on §§ 166 VwGO, 114, 119, and 121 ZPO.

[GRUENDE]

Der Kläger hat Anspruch auf die Bewilligung von Prozesskostenhilfe, weil die Voraussetzungen des § 166 VwGO i. V. m. § 114 Abs. 1 Satz 1, § 119 Abs. 1 Satz 1, § 121 Abs. 1 ZPO vorliegen.

Die vorläufige Festsetzung des Werts des Streitgegenstands für das Revisionsverfahren beruht auf § 63 Abs. 1, § 47 Abs. 1 Satz 1, Abs. 3 und § 52 Abs. 6 Satz 1 Nr. 2 und Satz 2 GKG.
