The Federal Administrative Court reversed the lower administrative court's refusal to admit an appeal, granting the applicant's request to allow the revision. The dispute concerned the validity of a municipal tax on betting offices, where the initial instance had found that a tax measured by a percentage of the betting stake did not violate the constitutional prohibition against similar taxes (*Gleichartigkeitsverbot*) relative to the specifically regulated federal race and sports betting taxes. The appellate court authorized the revision under § 132 Abs. 2 Nr. 2 VwGO based on a subsequent divergence of case law (*nachträgliche Divergenz*), as a later ruling by the same court had conclusively determined that such municipal taxes do conflict with Art. 105 Abs. 2a of the German Basic Law, rendering the lower court's contrary view incorrect.

Revisionszulassung; nachträgliche Divergenz in Fragen der kommunalen Wettbürosteuer

[TENOR]
