The German Federal Constitutional Court (BVerfG) declined to accept the constitutional complaint for a decision and rejected the applicant’s request for legal aid, thereby leaving the lower court's judgment in force. The dispute arose from a civil proceeding where the appellate court relied on a written expert opinion and the minutes of an oral hearing to render its decision. The Court held that the complaint was inadmissible under § 93a Abs. 2 BVerfGG because it failed to meet the substantiation requirements of § 23 Abs. 1 Satz 2 and § 92 BVerfGG; the applicants had neither submitted nor sufficiently reproduced the essential documents (the expert report and hearing minutes) that were crucial for the constitutional assessment, in violation of established procedural case law.
