The Second Senate of the Federal Constitutional Court issued a decision referring the case to the Full Court, as it intends to deviate from the legal opinions previously established by the First Senate regarding the constitutionality of the Air Security Act. The dispute concerns the 2005 amendments to the Act, specifically the provisions authorizing the military to shoot down civilian aircraft in imminent terrorist threats, challenging the legislative competence of the federal government and the compatibility of such measures with the constitution. The critical legal issue involves whether the authority to shoot down civilian aircraft can be grounded exclusively in Article 35(2) and (3) of the Basic Law (regarding defense against foreign armed attack) rather than Articles 73(1) or 73(6), whether this constitutional basis permits the use of specifically military weapons against civilians, and whether the emergency power granted to the Federal Minister of Defense violates the procedural safeguards of Article 35(3) Sentence 1.
