The Federal Court of Justice (BGH) rejected the defendant's appeal, upholding the lower court's conviction for possession of child pornography and upholding the sentencing rationale. The case involved a defendant convicted under § 184b Abs. 4 StGB for possessing videos of actual sexual acts involving minors, with the lower court using the fact that the videos depicted real events rather than simulated ones as an aggravating factor during sentencing. The appellate court ruled that this consideration did not violate § 46 Abs. 3 StGB (the statutory prohibition against using certain facts for sentencing purposes) and was permissible under the circumstances. Additionally, the court affirmed the conviction for possession of youth pornography under § 184c StGB, noting that a subsequent legislative amendment did not affect the case because the victims' lack of consent was established due to the videos being secretly recorded, thus excluding valid consent at the time of creation.

Besitz kinderpornografischer Schriften: Strafschärfende Berücksichtigung der Wiedergabe eines tatsächlichen Geschehens

[TENOR]
