The German Federal Court of Justice (BGH) granted admission of the appeal (Revision) regarding a claim of €42,047.69 plus interest, allowing the plaintiff to pursue the case on the merits, while rejecting the defendant’s broader complaint against the lower court’s refusal to admit appeal. The dispute concerned an insolvency avoidance action (Insolvenzanfechtung) where the defendant, having received funds from the insolvent debtor, argued that its forwarding of a €5,000 portion to a tax authority excused it from full liability for the return of the asset. The court held that the definition of the "counterparty" (Anfechtungsgegner) under § 133 Abs. 1 Satz 1 InsO encompasses any person who acquired a valuable position to the detriment of the insolvency estate, and the defendant’s failure to return the full amount was decisive; specifically, the subsequent transfer to a third party does not absolve the recipient of liability because, under § 143 Abs. 1 Satz 2 InsO, a recipient who knows of the lack of legal basis is subject to the enhanced liability of an unjust enrichment debtor, meaning the entire asset remains recoverable.

Insolvenzanfechtung: Rückgewährpflicht des Anfechtungsgegners bei Weiterleitung des zurückzugewährenden Vermögenswertes

[TENOR]
