The German Federal Court of Justice (BGH) 5th Criminal Senate dismissed the appeals of two defendants against a conviction by the Potsdam Regional Court, ordering the appellants to bear the costs of their legal remedies and the necessary expenses of the co-plaintiff. The dispute centered on criminal liability where the trial court’s judgment was challenged, specifically regarding the admissibility of drawing unfavorable inferences from the defendants' late statements during the main proceedings and the extent of judicial reasoning provided. The court held that while the trial court erred in relying on the late timing of the statements for negative inferences, this error did not affect the validity of the conviction because the court’s conviction was firmly grounded in independent, substantial evidence including surveillance footage, phone calls, DNA evidence, partial confessions, and possession of stolen goods, which also effectively rebutted the defendants' later claims. The BGH further clarified that the trial court was not required to reproduce the entire course of proceedings or irrelevant details in its judgment, but only needed to clearly highlight the decisive aspects that formed the basis of its conviction, finding that excessive detailed discussion of minor "mantrailing" results did not undermine the final judgment.

Beweiswürdigung im Strafverfahren: Nachteilige Würdigung später Einlassung des Angeklagten und Anforderungen an die Urteilsgründe

[TENOR]

November 1954 – 5 StR 392/54; Beschluss vom 21. Juli 2011 – 5 StR 32/11 Rn. 21).
