Appointment of court counsel under § 78b ZPO: substantiation of diligent search for an attorney
Sintesi Legislator
Generato dall'IAThe Federal Court of Justice (BGH) rejected the defendant's application for the appointment of a court-assigned attorney and dismissed the defendant's non-acceptance complaint for lack of admissibility, thereby leaving the decision of the Düsseldorf Higher Regional Court in force. The dispute concerned the defendant's failure to meet the procedural requirements for appealing the lower court's judgment, specifically the inability to provide proof of diligent efforts to retain a BGH-authorized attorney after the original counsel withdrew. The court held that the conditions for the appointment of an ex officio attorney under § 78b ZPO were not met because the defendant failed to substantiate that he had made reasonable efforts to find new counsel, and the non-acceptance complaint was procedurally defective under § 544 Abs. 2 ZPO as it was not reasoned within the statutory deadline by a permitted attorney, with the defendant ordered to bear the costs.

Notanwalt: Voraussetzungen für die Beiordnung
[TENOR]
