Woodshed and Barn Permit Appeal Settlement
Sintesi Legislator
Generato dall'IAAn appellant challenged a governmental decision that upheld a municipal denial of a building permit for a woodshed and barn on a specific property. During a site inspection hearing, the parties reached an agreement whereby the appellant would withdraw the appeal in exchange for submitting new construction applications: one for a woodshed/storage facility to be attached to the existing structure, and another for a small sheep pen/barn, with the commitment to limit the number of sheep and remove the structure if the husbandry ceased, with the relevant departments issuing favorable preliminary notices for both revised applications. Consequently, the administrative court struck the appeal from the record without imposing any costs or reimbursement of legal fees.
