A municipal resolution awarded hydraulic works for a new aqueduct following a public tender, which was appealed by citizens alleging the necessary credit had not been allocated by the local legislative body, and the administrative court ruled in favor of the appellants, annulling both the municipal award and the State Council's affirming decision because the award was issued unconditionally without the prerequisite legislative authorization or an explicit reservation for subsequent legislative approval, especially since the municipal council had subsequently refused the necessary funding.

segretario: · Leopoldo Crivelli

statuendo sul ricorso 16 giugno 1995 di

__________ __________ __________ __________ contro

la decisione 7 giugno 1995 (n. 3145) con cui il Consiglio di Stato respinge l'impugnativa inoltrata dagli insorgenti avverso la risoluzione 27 febbraio 1995 del municipio di __________ mediante la quale sono state deliberate alla ditta __________ le opere da idraulico relative all'acquedotto __________;

viste le risposte:

- 23 giugno 1995 della Dipartimento delle istituzioni;

- 27 giugno 1995 del municipio di __________;

- 4 luglio 1995 dei __________;

- 5 luglio 1995 del Consiglio di Stato;

letti ed esaminati gli atti;

ritenuto, in fatto

che con decisione 27 febbraio 1995 - resa in esito a pubblico concorso - il municipio di __________ ha deliberato alla ditta __________ di __________ le opere da idraulico relative alla costruzione dell'acquedotto __________;

che la predetta risoluzione è stata impugnata davanti al Consiglio di Stato dai ricorrenti indicati in epigrafe, che eccepivano, fra l'altro, che il legislativo comunale non aveva mai stanziato il credito necessario;

che con giudizio 7 giugno 1995 il Consiglio di Stato ha respinto il ricorso, ritenendo che comunque l'opera avrebbe ancora dovuto essere ratificata dal legislativo comunale, peraltro già convocato per il 29 maggio 1995 (!);

che contro il predetto giudizio governativo i soccombenti insorgono davanti al Tribunale cantonale amministrativo, chiedendone l'annullamento in considerazione del fatto che il consiglio comunale, nel frattempo, ha rifiutato il credito necessario all'esecuzione dell'opera;

che il ricorso è avversato dal Consiglio di Stato, dal municipio di __________ e dalla ditta __________, deliberataria delle opere;

considerato, in

diritto

che la competenza del Tribunale cantonale amministrativo, la legittimazione attiva dei ricorrenti, cittadini attivi di __________, e le tempestività dell'impugnativa sono indiscutibilmente date dagli art. 208 LOC, 43, e 46 PAmm;

che, per principio, è ammissibile che il municipio pubblichi un bando di concorso per lavori o forniture prima che il legislativo comunale decida l'esecuzione di determinate opere o l'acquisto di determinati beni e stanzi i necessari crediti;

che l'aggiudicazione non può tuttavia avvenire senza una preventiva deliberazione da parte del legislativo, ovvero, in assenza di questa, senza la chiara ed esplicita riserva a favore delle decisioni che il legislativo deve necessariamente ancora rendere (cfr. STA 18.10.1978 in re T.; RDAT 1979 N. 18 pag. 29);

che, così stando le cose, la delibera censurata risulta lesiva del diritto siccome espressa in maniera incondizionata e senza la preventiva decisione del legislativo;

che, di conseguenza, il ricorso va accolto, annullando la risoluzione municipale impugnata e quella governativa che la conferma senza nemmeno tener conto del fatto che il consiglio comunale aveva nel frattempo deciso di non eseguire le opere in oggetto;

che, dato l'esito, si prescinde dal prelievo di una tassa di giustizia e dall'assegnazione di ripetibili;

visti gli art. 113, 208 LOC, 3, 18, 28, 31, 60, 61, 65 PAmm, dichiara e pronuncia:

1. Il ricorso è accolto.

§. Di conseguenza sono annullate:

1.1. la decisione 7 giugno 1995 del Consiglio di Stato (n. 3145);

1.2. la delibera 27 febbraio 1995 del municipio di __________.

2. Non si prelevano né tasse, né spese.

3. Non si assegnano ripetibili.

3. Intimazione a: · __________
