An official, removed from their technical position by a Cantonal Council decision, appealed the dismissal; however, during the appeal process, it was established that the official had been declared 100% disabled by the federal insurance authority effective a date prior to the appeal hearing. Upon learning of the disability ruling, the Cantonal Council voluntarily rescinded its initial removal decision, leading the Administrative Court to uphold the appeal, nullify the removal decision, and award the appellant costs and recompense, as the underlying administrative matter had been resolved by the subsequent disability determination.
