Unsigned Appeal Dismissed for Procedural Defects
Sintesi Legislator
Generato dall'IAAn individual filed an appeal against a health insurance decision, submitting an unsigned document titled "request for a technical discussion" concerning past events, which lacked any supporting documents or specific grounds for appeal. The delegated judge provisionally registered the submission as an appeal and ordered the appellant to complete the filing, including producing the contested decision and providing arguments and specific claims, within a 15-day period; however, as the appellant failed to respond to this formal notification, the court declared the appeal inadmissible due to its initial deficiency (being unsigned and lacking substance) and the subsequent failure to remedy these defects, although no court fees were imposed due to the appellant's superficial conduct.

Although not explicitly cited in the dispositive orders 1-3, the context strongly implies that the declaration of inadmissibility (Order 1) and the decision on costs (Order 2) are governed by the procedural rules applicable to this court. However, strictly adhering to the rule of including only what is *explicitly* cited in the numbered orders, and noting that Order 1 is a general declaration of inadmissibility without citing a specific procedural basis for that inadmissibility (like an Art. 92 LTF equivalent for this court, which is not present), and Order 2 does not cite the provision governing the cost decision itself (only stating the decision on costs/fees), I must check if any provision is cited in the reasoning section that is also cited in the dispositive. The only procedural citation in the reasoning that *relates* to the court's action is 'art. 4 cpv. 3 LPrTCA', which regulated the completion order, not the final ruling's substance or cost allocation, though it enabled the final ruling. Since the final dispositive only contains orders 1, 2, and 3, and only Order 2 mentions costs ('Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato'), I must check if the rule for Order 2 is cited. It is not cited. Therefore, based strictly on explicit citation in Orders 1, 2, or 3, there are no provisions fitting the criteria, except for the procedural provision cited *before* the dispositive that dictated an action taken by the judge which led to the situation addressed in the dispositive (the failed completion attempt). Given the lack of explicit citation for the inadmissibility itself (Order 1) or the cost waiver (Order 2) in the dispositive, I will include the only non-cost provision cited in the reasoning that deals with the procedure that led to the decision, even though it's not explicitly in 1, 2, or 3, as it is an integral part of the sequence leading to the final order, *if* the instruction allows for provisions that *enabled* the final order if no other provision fits. However, the rule is strict: 'Include a provision **only if it is explicitly cited in the dispositive (the numbered orders at the end of the decision)**.' Since no provision is explicitly cited in orders 1, 2, or 3, the output must be empty or only contain cited cost/procedural rules if they *were* cited in 1, 2, or 3. As none are cited there, the array must be empty.

considerato,
- che RI 1 si è rivolto al Tribunale cantonale delle assicurazioni con atto intestato "richiesta di colloquio";
- che con tale atto egli chiede *"un colloquio tecnico"* con un *"incaricato del Tribunale ..."* e ciò *"... in merito alle vicende succedutemi anzitempo"*;
- che nessun documento è stato allegato alla richiesta;
- che l'atto, registrato dal Tribunale quale ricorso per non pregiudicare in nulla i diritti dell'interessato, non risulta firmato;
- che, l'8 giugno 2009, il Giudice delegato ha ordinato all'esponente la completazione del gravame segnalando in particolare che, qualora fosse stata l'intenzione di RI 1 di *"impugnare una decisione emessa su reclamo o su opposizione"*, occorreva produrre la decisione impugnata con argomentazioni e precise conclusioni;
- che il Giudice delegato ha concesso - a norma dell'art. 4 cpv. 3 LPrTCA - un termine di 15 giorni per provvedere in merito;
- che a RI 1, siccome domiciliato all'estero, il decreto di completazione è stato intimato a mezzo invio raccomandato con avviso di ricezione;
- che l'atto è pervenuto a RI 1 il 12 giugno 2009 come desumibile dall'attestazione della posta di __________;
- che il termine è trascorso infruttuoso;
- che il Giudice deve quindi dichiarare l'irricevibilità dell'impugnativa non firmata e senza specifica dell'oggetto contro cui si aggrava. Ciò nonostante nei confronti di RI 1 sia stata pronunciata una decisione su reclamo da parte dell'Ufficio assicurazione malattia il 14 maggio 2009 in materia di obbligo assicurativo LAMal come appurato mediante verifiche presso gli assicuratori sociali e l'amministrazione;
