Withdrawal of Appeal Against Health Insurance Subsidy Denial
Sintesi Legislator
Generato dall'IAAn individual appealed a decision from the social insurance institute that denied a subsidy under the cantonal health insurance law for the year 1999, asserting that the denial was based on incorrect tax data and attaching supporting correspondence with the tax authority. Subsequently, the appellant communicated to the court their decision to withdraw the appeal, leading the court, based on procedural rules, to strike the case from the rolls without imposing a judicial fee, with costs borne by the state.

This article is cited in the preamble to the dispositive section, indicating the procedural basis for the court's action (striking the case from the roll due to withdrawal).
Although the text does not explicitly contain the letters 'LTF' but rather mentions 'giustizia' and costs being borne by the State in order 2, which often corresponds to cost regulations (like Art. 66 in the federal context or its cantonal equivalent for imposing costs/expenses), the actual cited provision regarding the non-perception of a fee and placing expenses on the State is found in the specific local procedural rules cited (Art. 23 LPTCA and Art. 352 CPC). Since there is no explicit citation corresponding to Art. 66 LTF in order 2, and the explicit cost rule in the dispositive is *non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato*, which is covered by the context of the cited procedural articles (Art. 23 LPTCA and Art. 352 CPC) which govern the entire decision framework, no separate cost provision strictly matching the requested format will be included unless explicitly cited as such in the final orders. Order 2 details the financial consequences but does not cite a standalone cost article like Art. 66 LTF.
