Appeal Mootness Due to Payment of Arrears
Sintesi Legislator
Generato dall'IAAn individual filed an appeal alleging denial of justice against an accident insurer, seeking retroactive daily allowances starting from January 1, 2001, but subsequently informed the court that the insurer had paid all arrears for the period up to May 31, 2001, prompting the insurer to request the appeal be struck as moot. Despite later reports of delayed payments for August and September, the court determined that because the initial claim for the arrears up to May 31, 2001, had been satisfied, the appeal regarding that specific grievance was rendered devoid of object, and consequently ordered the case stricken from the rolls without imposing court fees, with costs borne by the State.
