1. Si le Conseil-exécutif ou le Tribunal administratif, après un échange de vues avec la Cour suprême, estime compétents les tribunaux civils ou pénaux bernois et qu’il ne s’agisse pas d’un cas réglé à l’article 7, l’autorité saisie de l’affaire adresse le dossier à la Cour suprême avec sa décision sur la question de compétence. Si la Cour suprême conteste la décision, le Grand Conseil statue sur la compétence, à la requête de l’autorité saisie la première de l’affaire (art. 79, al. 1, lit. d de la Constitution cantonale).
2. Si une autorité inférieure de justice administrative estime compétents les tribunaux civils ou pénaux bernois et qu’il ne s’agisse pas d’un cas réglé à l’article 7, elle transmet le dossier à l’autorité de recours pour décision sur la question de compétence.
