Synthèse Legislator

Généré par l'IA

A litigant filed an appeal alleging that the Cantonal Office of Disability Insurance (OCAI) failed to conduct necessary investigations despite their request, but the OCAI subsequently informed the court that it had reviewed the file, annulled its prior decisions dated February 9 and March 19, 2004, and decided to resume the instruction process. The court reasoned that under the law governing the general part of social insurance law, the administration is permitted to reconsider its decision until the submission of its pre-appeal statement, which rendered the appeal moot, leading the court to strike the case from the roll.

Madame M__________, soit pour elle son époux M__________, · recourante

contre

OFFICE CANTONAL DE L’ASSURANCE-INVALIDITE, rue de Lyon 97 à Genève · intimé

Vu la procédure, les pièces et les conclusions des parties ;

Attendu que dans son recours du 10 mai 2004, la recourante s’étonne de ce qu’aucune instruction n’a été faite par l’OCAI malgré sa demande ;

Que dans son préavis du 3 juin 2004, l’OCAI indique avoir effectué un nouvel examen du dossier, avoir en conséquence annulé sa décision du 9 février 2004 et sa décision sur opposition du 19 mars 2004, et avoir décidé de reprendre l’instruction ;

Qu’en application de l’art. 53 de la loi fédérale sur la partie générale du droit des assurances sociales (LPGA), l’administration peut reconsidérer sa décision jusqu’à l’envoi de son préavis ;

Qu’il en découle que le recours est devenu sans objet, et que la cause doit être rayée du rôle.

LE TRIBUNAL CANTONAL DES ASSURANCES SOCIALES

(conformément à la disposition transitoire de l’art. 162 LOJ)
