Cantonal Court Award of Costs After Federal Tribunal Remand
Synthèse Legislator
Généré par l'IAFollowing a prior appeal that was partially admitted and subsequently annulled by the Federal Tribunal, the Cantonal Court of Social Insurance was tasked with ruling solely on the matter of costs after the claimant partially prevailed in the underlying dispute against the Cantonal Office for the Elderly. The court reasoned that a party who partially succeeds in their appeal is entitled to costs as compensation for their expenses and those of their attorney, and applying its standard criteria based on the number of submissions and hearings, the court determined the appropriate award for the successful claimant to be 2,500 Swiss Francs against the respondent office.
