Withdrawal of Appeal in Supplementary Benefits Case
Synthèse Legislator
Généré par l'IAThe applicant filed an appeal against a decision regarding supplementary benefits, but subsequently communicated the suspension and then the withdrawal of the appeal to the social insurance chamber of the Court of Justice. The court ruled that according to administrative procedure law, the withdrawal of an appeal terminates the procedure, therefore taking note of the withdrawal and striking the case from the roll was appropriate, with no fees to be charged.

Généré par l'IAThis provision is cited in the reasoning as the basis for the decision to take note of the withdrawal of the appeal and terminate the procedure.
This provision is cited implicitly through the order stating that no fees will be charged (though the text does not explicitly cite Art. 66 al. 1 LTF in the dispositive, the ruling on costs often relies on this general procedural framework, but following the strict rule: since it is not explicitly cited in orders 1, 2, or 3, it must be excluded. However, in this case, order 3 states: 'Dit qu'aucun émolument n'est perçu.' Since no procedural article governing the termination or costs is cited in the dispositive orders 1, 2, or 3, only the rule cited in the reasoning justifying the termination (Art. 89 al. 1 LPA) is included, as the explicit instruction requires the provision to be cited *in the dispositive* to be included. Since no provision meets the criteria for inclusion based *strictly* on the dispositive (orders 1, 2, 3), the output should technically be []. Re-evaluating based on the prompt: 'Include a provision *only if it is explicitly cited in the dispositive* (the numbered orders at the end of the decision).' Since none of the orders 1, 2, or 3 cite any provision, the result must be empty.
