Insurer Appeal Moot Due to Subsequent Administrative Decision Reversal
Synthèse Legislator
Généré par l'IAAn insurer appealed a decision by the Disability Insurance Office (OAI) that refused medical measures; however, the OAI subsequently issued a new decision on January 29, 2010, which annulled its initial decision and ordered a supplementary investigation and a new ruling. The Cantonal Social Insurance Court noted that under the relevant federal law, an insurer can reconsider a decision against which an appeal has been filed before the notification of its opinion to the appeal authority, confirming that this procedure was followed in this instance, and therefore declared the appeal moot and removed the case from the roll.
