Legislator summary

AI generated

The Supreme Court of Slovenia ruled that the District Court in Žalc retained jurisdiction over a subsequent enforcement application filed by the creditor. The creditor had previously obtained a final enforcement order against the debtor's bank accounts, and now sought enforcement against the debtor's real estate. The court held that under the Law on Enforcement and Security, when new enforcement measures are cumulatively added, the territorial jurisdiction follows the original enforcement measure, thereby dismissing the lower court's claim of incompetence.

V tej izvršilni zadevi je pristojno Okrajno sodišče v Žalcu.

[JEDRO]

To stanje ureja tretji odstavek 34. člena Zakona o izvršbi in zavarovanju (ZIZ, Ur.l. člena Zakona o pravdnem postopku v zvezi s 15. členom ZIZ.
