Legislator summary

AI generated

The Supreme Court of Slovenia ordered the transfer of an enforcement proceeding to a different court. The debtor argued that the original court's judge, who was the creditor's mother and legal representative, should recuse herself, while the creditor maintained her position. The court ruled that the judge's familial relationship constituted a significant reason under the relevant procedural law, necessitating a change of venue to ensure impartiality.

In 2003/00679 z dne 17.5.2004.
